McDowell’s minimal empiricism holds that experience, understood as providing conceptually articulated contents, plays a role in the justification of our beliefs. We question this idea by contrasting the role of perceptual experience in moral and non-moral judgments and conclude that experience per se is irrelevant in the former case and should also be so in the latter one: only with the help of adequate beliefs experience can provide a connection with the world. nos últimos anos, John McDowell tem proposto uma concepção de filosofia em que o objetivo da disciplina não é oferecer teses substanciais, mas antes revelar modos de pensar e premissas ocultas que estão na base da filosofia construtiva. Esta visão terapêutica tem sido chamada ‘quietismo’ e deve muito a algumas idéias favoritas de Wittgenstein ao longo de toda a sua vida. No entanto, a obra de Wittgenstein (e, talvez, também a de McDowell) parece oscilar entre duas compreensões de quietismo: pode-se (...) ser quietista por não macular aquilo que é mais importante com discussões explícitas ou pode-se ser quietista por não ter nada a dizer. Argumentaremos que o segundo tipo do quietismo não implica recusar em se ocupar com a filosofia do passado, nem tampouco adotar uma atitude contemplativa. A concentração sobre o particular, em ética tanto quanto em qualquer outra área da filosofia, é suficiente para minar as ambições universalistas da filosofia tradicional e descortinar um aumento na ação filosófica. Richard Moran has argued, convincingly, in favour of the idea that there must be more than one path to access our own mental contents. The existence of those routes, one first-personal—through avowal—the other third-personal—no different to the one used to ascribe mental states to other people and to interpret their actions—is intimately connected to our capacity to respond to norms. Moran’s account allows for conflicts between first personal and third personal authorities over my own beliefs; this enable some instances of (...) Moore-paradoxical cases to be meaningful. In this paper we reflect on the consequences of this view for the acquisition of beliefs, and argue that, as in the moral case, excessive concentration on a thirdpersonal understanding of thought undermines the very idea of being directed to the world and of being capable to fully own our own beliefs. We suggest that maybe too much attention to epistemic virtues or tojustification is misdirected and could produce beliefs that are themself not first-personal enough. (shrink)

Schaffer (2010) argues that the internal relatedness of all things, no matter how it is conceived, entails priority monism. He claims that a sufficiently pervasive internal relation among objects implies the priority of the whole, understood as a concrete object. This paper shows that at least in the case of an internal relatedness of all things conceived in terms of physical intentionality - one way to understand dispositions - priority monism not only doesn't follow but also is precluded. We conclude (...) that the internal relatedness of all things is compatible with several different ontologies (including varieties of pluralism) but entails nothing concerning dependence between concrete objects. This paper argues that the normative character of our unreflective situated behaviour is not factual. We highlight a problematic assumption shared by the two most influential trends in contemporary philosophy of cognitive science, reductionism and enactivism. Our intentional, normative explanations are referential, descriptive or factual. Underneath this assumption lies the idea that only facts can make true or false our attributions of cognitive, mental and agential abilities. We will argue against this view by describing the main features and problems of (...) reductionism and enactivism and then we will offer two arguments against this shared factualist assumption: (1) normative vocabulary is ineliminable if we want a complete explanation of our situated practices; and (2) the factualist assumption is a species of the is-ought fallacy. Finally, we will claim that a folk psychological explanation of our normative practices is fully compatible with ontological naturalism when such descriptivist or factualist assumption is rejected. In this paper, we offer a criticism, inspired by Wittgenstein’s rule-following considerations, of the enactivist account of perception and action. We start by setting up a non-descriptivist naturalism regarding the mind and continue by defining enactivism and exploring its more attractive theoretical features. We then proceed to analyse its proposal to understand normativity non-socially. We argue that such a thesis is ultimately committed to the problematic idea that normative practices can be understood as private and factual. Finally, we offer a (...) characterization of normativity as an essentially social phenomenon and apply our criticisms to other approaches that share commitments with enactivism. (shrink)

It is common to criticize the idea of objectivity by claiming that we cannot make sense of any cognitive contact with the world that is not constituted by the very materials of our thinking, and to conclude that the idea must be abandoned and that the world is ‘well lost’. We resist this conclusion and argue for a notion of objectivity that places its source within the domain of thoughts by proposing a conception of facts, akin to McDowell’s, as thinkable (...) while independent of any act of thinking. In this paper we challenge the notion of ‘normativity’ used by some enactive approaches to cognition. We define some varieties of enactivism and their assumptions and make explicit the reasoning behind the co-emergence of individuality and normativity. Then we argue that appealing to dispositions for explaining some living processes can be more illuminating than claiming that all such processes are normative. For this purpose, we will present some considerations, inspired by Wittgenstein, regarding norm-establishing and norm-following and show that attributions of (...) normativity to non-social agents are deeply paradoxical. The main conclusions of our discussion are: (1) circular and internal explanations centred on the stability of living systems are insufficient to account for processes where the environment plays an important role, such as adaptation. Enactivism is not an explanatory alternative to evolutionary biology but needs it as a complement to accounts focused on the internal self-assembly of organisms; (2) though we share enactivism’s anti-representational spirit, we argue that ecological psychology can offer a better account of perception. Davidson’s anomalous monism, his argument for the identity between mental and physical event tokens, has been frequently attacked, usually demanding a higher degree of physicalist commitment. My objection runs in the opposite direction: the identities inferred by Davidson from mental causation, the nomological character of causality and the anomaly of the mental are philosophically problematic and, more dramatically, incompatible with his famous argument against the third dogma of empiricism, the separation of content from conceptual scheme. Given the anomaly of the (...) mental and the absence of psychophysical laws, there are no conceptual resources to relate mental and physical predicates. We fall in the third dogma if we claim that the very same token event is mental and physical. One of the premises must be rejected: I will claim that we do not need a law to subsume cause and effect to be entitled to speak of causation. Davidson has never offered an argument to back this premise. Against such a dogma I will sketch some ideas pointing towards a different conception of causality, singularist and undetachable from explanatory practices. (shrink)

The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. Una de las estrategias legislativas más extendidas en el ámbito penal es la de establecer límites mínimos y límites máximos para cada delito. De esta manera, al momento de determinar la pena para el caso en concreto, los jueces utilizan estos límites como guías de menor o mayor reproche por la conducta cometida. Entre los elementos en los que se apoyan los jueces para esta determinación se encuentran la culpabilidad del agente al momento de cometer el hecho y la lesividad (...) de su conducta delictiva. Sin embargo, existen ciertos casos en los cuales la pena mínima se muestra desproporcionada con el reproche que merece el agente. En particular, en este trabajo abordaré estas situaciones a fin de reconstruir algunas discusiones existentes en la filosofía jurídica y política. (shrink)

We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) A lo largo de su obra Ronald Dworkin ha planteado una cuestión crucial acerca de la libertad de expresión: ¿es un derecho tan importante que su protección exige permitir formas de expresión que consideramos despreciables, ofensivas o socialmente dañinas? En este trabajo me gustaría analizar la reflexión del filósofo en torno a tal cuestión, centrándonos en la pornografía y los discursos del odio. Estas formas de expresión constituyen un desafío para los defensores de esa libertad, pues nos obligan a revisar (...) los argumentos tradicionales empleados en su defensa. Para ello, consideraré en primer lugar la cuestión de si existe un derecho a la pornografía y cómo se podría justificar. Después revisaré su polémica con autoras feministas como Catharine MacKinnon a propósito de la prohibición de la pornografía, pues varias de las cuestiones son pertinentes en relación con los discursos del odio. Para concluir examinaré el modo en que R. Dworkin replantea la defensa de la libertad de expresión, pues tiene relevancia en el contexto de la discusión sobre la penalización de los discursos del odio. (shrink)

Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. O presente trabalho pretende, sobretudo, relevar o poder argumentative do orador, seguindo de perto as considerações de Chaïm Perelman sobre a Retórica como "discurso que visa convencer ou persuadir". Simultaneamente, desta-cam-se os голоl ou valores universais patenteados no texto de Vieira e que constituem a base da (...) teoria da argumentação de Oswald Ducrot. \\\ In the "Sermon for the good success of the Portuguese army against Holland's", Vieira displays all his gifts as an uncommon writer, an excellent theologian, a non negligeable jurist, a convinced humanist, and, above all, a wholehearted patriot. This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". At the same time, we emphasize, as displayed in Vieira's text, the "topoi", or universal values, that are the basis of Oswald Ducrot's argumentation theory. (shrink)

I discuss an aspect of the relation between accounts of de se thought and the phenomenon of immunity to error through misidentification. I will argue that a deflationary account of the latter—the Simple Account, due to Evans —will not do; a more robust one based on an account of de se thoughts is required. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El día dieciséis de julio de este año, un día después de la festividad de san Buenaventura, este santo franciscano, doctor de la Iglesia, recibió un regalo: una de las personas que aquí y ahora más conocía de su obra, pensamiento y fuentes, iba a ir a visitarlo. Ambos tenían, al fin, la oportunidad de conocerse en persona. Para sus amigos fue un regalo muy caro. Nuestro amigo Francisco de Asís Clavero Blanco nos dejó físicamente, pero sus estudios y su (...) obra perdura y perdurará con nosotros.' Decir que alguien conoce a san Buenaventura no es fácil, pues en este pensador franciscano se conjugan aspectos filosóficos, teológicos, históricos y espirituales que llevan en sí una carga histórica compleja que se desarrolla en un tiempo, a la vez, complejo, apasionante y alejado en el tiempo: el siglo XIII. No en vano, la figura de san Buenaventura fue tildada por algunos como "la más medieval de la filosofía del Medioevo".Pero Francisco de Asís Chavero se preparó para afrontar este reto y más. Nacido en Rivera del Fresno en 1945, profesó en la Orden Franciscana en la Provincia Bética el 6 de agosto de 1967. Se ordenó presbítero el 21 de julio de 1973. Cursó filosofía y teología en el Centro de Estudios Teológicos de Sevilla, en la Facultad de Teología de Granada, en el Pontificio Ateneo Antonianum y en el Centro de Investigación de Quarachi de la Orden Franciscana situada en Grottaferrata en Roma. Estos estudios hicieron que quedara corta su titulación de Licenciado en S. Teología, sección Histórico?Dogmática. En el momento en el que le sorprendió la muerte era profesor de Teología Sistemática, Antropología Teológica y Pensamiento Franciscano en el Instituto Franciscano de Murcia.El perfil de su formación, trabajo y dedicación nos ayuda a comprender por qué a Francisco de A. Chavero no se le escapaba ningún detalle del pensamiento bonaventuriano. No había aspecto de su pensamiento filosófico, teológico, espiritual o franciscano que no conociera. Su obra, sus ediciones, las fuentes, los estudios e interpretaciones sobre el doctor Seráfico eran, no sólo conocidas por él, sino también estudiadas, pensadas e interpretadas. De todo lo que acabo de decir dan fe sus escritos y las extensísimas notas a pie de página que nos regalaba. Hablando de su trabajo siempre mostraba la visión de fondo que impregnaban sus estudios: el de historiador de la teología. Esto no significa que desde esta perspectiva histórica no fuera capaz de percibir y apuntar conceptos nuevos y visiones originales.Francisco de Asís Clavero Blanco colaboró en numerosas revistas como Verdad 1, Vida, Carthaginensia, Estudios Franciscanos, Doctor Seraphicus, Themata, Archivum Franciscanum Historicurn, etc. Era miembro de la Sociedad Escotista Internacional , del Centro di Studi Bonaventuriani , Asociación Hispánica de Estudios Franciscanos y compañero de la Sociedad Española de Filosofía Medieval . Me gustaría en estas páginas repasar aunque sea brevemente el legado intelectual de este pensador franciscano. (shrink)

En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? Aristóteles establece los principios de la generación en GC 1 pero en adelante construye genuinas demostraciones científicas apoyándose precisamente en aquellos principios. Reconstruiremos un pasaje puntual de GC 2. 10 para defender la hipótesis del uso real de la demostración científica en los tratados científicos. La particularidad específica de este trabajo es que esta demostración científica apunta a hacer explícita, (...) dentro del marco de la cuádruple causalidad aristotélica, la causalidad eficiente del fenómeno de la generación. La premisa que guía nuestra investigación es que Poética es un tratado científico, i. e., que la investigación desarrollada en dicha obra se corresponde con el examen de una téchne. Defendemos que el método utilizado se corresponde con el método general de investigación denominado “salvar las apariencias”. Tal método es expuesto con más detalle en otras obras del corpus pero lo presuponemos utilizado en Poética. Si bien el método presupone la recolección de datos, no se limita a eso puesto que (...) el paso ulterior consiste en la caracterización de las diferencias y la exposición de las cuatro causas del fenómeno. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. Algunos presupuestos teológicos de la crisis de Occidente Some theological presuppositions of the crisis of the West -/- Manuel Ocampo Ponce Universidad Panamericana Departamento de Humanidades -/- Resumen. Muchos hablan de una crisis en occidente y de los distintos factores que han contribuido a la misma. Sin embargo, no son tantos los que involucran los factores teológicos que han influido en dicha crisis. De aquí que el presente estudio sea un intento por presentar algunos de los presupuestos teológicos de (...) lo que se ha llamado “la crisis de occidente”. Se trata de presentar ciertas ideas filosóficas que han repercutido en las propuestas de algunos teólogos y pensadores del siglo XX y lo que va del XXI, y de demostrar que dichas ideas han producido cambios significativos en la concepción de Dios, en la concepción de las dimensiones personal y social del hombre, y con estas en la organización del mundo contribuyendo, en distintos niveles, lo que se ha denominado la crisis de Occidente. -/- Palabras clave: Dios, Cristianismo, ser, Teología, Metafísica, crisis, agnosticismo, relativismo, secularismo. -/- Abstract. Many speak of a crisis in the West and of the various factors that have contributed to it. However, few mention the theological factors that have influenced this crisis. Hence, the present study is an attempt to present some of the theological presuppositions of what has been called "the crisis of the West". The study presents certain philosophical ideas that have had repercussions on the proposals of some representative theologians of the twentieth and twenty-first centuries. It seeks to demonstrate that these ideas have produced some changes in the conception of God, in the conception of personal and social dimensions and in the organization of the world. These have favored, at different levels, what has been called the crisis of the West. -/- Key words: God, Christianism, being, Theology, Methaphisics, crisis, agnosticism, relativism, secularism. -/- En las últimas décadas se ha hablado mucho de que el mundo occidental se encuentra en crisis. Crisis de pensamiento, crisis de valores, crisis moral, crisis en los ámbitos científicos, artísticos, humanos, ambientales, etc. Sin embargo, es necesario aclarar que, para comprender Occidente y su crisis, es imprescindible considerar el papel del cristianismo como elemento fundamental de la cultura occidental. No podemos dejar de lado que, si el cristianismo tiene un peso en el desarrollo de Occidente, también debe tener un peso en sus logros y en sus decadencias y fracasos. En efecto, así como no podemos entender el mundo árabe si no conocemos el Islam, o Asia si no conocemos el budismo, tampoco podemos comprender Occidente si no conocemos el cristianismo. Esa es la razón por la que pensamos que cualquier análisis serio de la cultura de Occidente, ha de considerar el cristianismo como elemento clave para su comprensión. Pero hay que ser conscientes de que el cristianismo abarca muchos ámbitos especulativos y prácticos que, en una investigación de esta naturaleza, son imposibles de abarcar. Por lo mismo, el presente estudio se limita a mostrar de manera muy panorámica sólo algunos de los elementos teológicos de la crisis de Occidente que muchas veces son pasados por alto en distintos ámbitos, considerando que la Teología cristiana está conformada por una fuerte base filosófica. Como corolario de este estudio se deduce una solución que deviene de los mismos factores que han sido causas de la crisis. Se ha realizado una selección de algunos autores que he considerado como representativos de movimientos de pensamiento que han dado lugar a ciertos cambios importantes, y presentarlos demostrando el papel que ha tenido la modificación de la Teología cristiana en la crisis de Occidente. En la literatura jurídica existe un acuerdo generalizado en que los topes máximos de la pena establecidos la legislación son un límite infranqueable por los jueces. Sin embargo, al abordar el límite mínimo los desacuerdos comienzan a surgir. El objetivo del presente trabajo será el de defender que los mínimos penales, si bien son vinculantes para los jueces, pueden ser dejados de lado cuando las circunstancias particulares del caso lo ameriten. El método empleado será análisis conceptual, más precisamente, al contructivismo (...) interpretativista propuesto por Ronald Dworkin, aplicado al estudio de la jurisprudencia y la doctrina argentina. El resultado final será una justificación – apoyada en la concepción comunicativa del castigo – según la cual los límites mínimos pueden ser dejados de lado en casos concretos y excepcionales, como cuando la culpabilidad del acusado o la lesividad de su conducta se muestran desproporcionadas con el límite mínimo. De esta manera se busca dar respuesta a un problema que se encuentra presente en la práctica jurídica y, sobre todo, brindar herramientas argumentativas para que los operadores judiciales puedan resolver aquellos casos donde este límite se encuentre en discusión. Up to now researchers have maintained that Nietzsche’s philosophy has no concept of social justice or have hardly noticed such a concept. On the contrary, this article argues that social justice plays an important role in Nietzsche’s political thinking. It shows that his conception of justice is modelled after Plato’s antique concept of political justice. The main thesis of the paper is that this conception is embodied in Nietzsche’s notion of a well-ordered state or society. An additional thesis concerns the (...) anthropological basis of what Nietzsche holds to be a just social order. "A theoretical juice extractor: The role of mathematics in scientific explanation". There have recently been proposed cases where, supposedly, mathematics would play a genuinely explanatory role in science. These have been divided into those situations where the explanatory role would be played by mathematical operations, and those where it would be played by mathematical entities. In this article, I analyze some of these purported cases and argue that claims that mathematics can be genuinely explanatory are unfounded. La pregunta por el modo de orientar la vida se revela como una de las más serias y apremiantes. Tanto en su acepción sacra, que remite a una llamada trascendente, como en su concepción laica, que vincula el sentimiento de felicidad con la propia realización personal, la palabra vocación quiere indicar el modo adecuado que sigue el sujeto para desempeñarse con éxito en la vida. Quizá por ello, cuando se habla de vocación resuenan aquellos elementos que componen la identidad del (...) ser humano: corporeidad y espiritualidad, intimidad y relacionalidad, inteligencia y sensibilidad, conciencia y libertad, biografía personal e historia colectiva. El desencanto causado por la «liquidez» axioló­gica, la demagogia política, el pragmatis­mo económico, la incertidumbre eco­lógica, el narcisismo digital y la uniformidad cultural en los que parece haberse instalado la antropología del trashombre, urge a elaborar un nuevo modelo de orientación vocacional que enseñe a vivir desde la «autotrascendencia» y la «ultimidad personal», o sea, desde la alteridad, la relación, la libertad y el don. “Structuralism, Fictionalism, and the Applicability of Mathematics in Science”. This article has two objectives. The first one is to review some of the most important questions in the contemporary philosophy of mathematics: What is the nature of mathematical objects? How do we acquire knowledge about these objects? Should mathematical statements be interpreted differently than ordinary ones? And, finally, how can we explain the applicability of mathematics in science? The debate that guides these reflections is the one between mathematical realism and (...) anti-realism. On the other hand, the second objective is to discuss the arguments that use the applicability of mathematics in science to justify mathematical realism, and show that none of them reaches its aim. To this end, we will distinguish three aspects of the problem of the applicability of mathematics: the utility of mathematics in science, the unexpected utility of some mathematical theories, and the apparent indispensability of mathematics in our best scientific theories - in particular, in our best scientific explanations. Finally, I argue that none of these aspects constitutes a reason to adopt mathematical realism. (shrink)

La obra de Lévinas propone asumir la ética como Filosofía Primera. Allí convergen dos fuentes de inspiración filosófica, el pensamiento judío y la fenomenología, y la experiencia histórica de persecución, violencia y desconocimiento del otro que exigió a Lévinas criticar el totalitarismo ontológico griego con el propósito de hacer justicia a la Alteridad y dar primacía así a la Responsabilidad para con el Otro sobre la Libertad autónoma del Yo. Luego, el autor retorna la crítica de Lévinas a la fenomenología (...) de la conciencia y a la ontología hermenéutica de Heidegger, con la que Occidente lleva a término su limitada opción por el conocimiento y la manifestación del Ser. Rubio y Lévinas, en tercer lugar, señalan hacia una hermenéutica encarnada de nuestras relaciones con el Otro, a una reivindicación de la antropología filosófica que recupere el Sentido desde el Otro. Finalmente, el autor se refiere al terna de la muerte en Lévinas, y subraya, en relación con la desaparición del maestro Rubio que, nuestro adiós a él, significa el 'ante Dios' de todas nuestras relaciones no tematizables con el Otro y antes que todo. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. La lógica de la Edad Media se presenta a los lógicos contemporáneos, filósofos medievalistas, historiadores y filósofos de la lógica, como un campo tan fascinante como de difícil acceso. Parece demasiado intrincado para casi cualquier investigador de estas áreas encontrar la punta del ovillo que lo conduzca a transitar una presentación ordenada e inteligible de la lógica medieval. Este libro pretende solucionar este problema. Para ello, presenta de manera ordenada y autocontenida los desarrollos lógicos de la parte técnicamente más evolucionada (...) de la lógica de la Edad Media: el siglo XIV. A diferencia de otras presentaciones no evade los hechos históricos y culturales que conforman el panorama de la época ni las cuestiones filosóficas detrás de los desarrollos lógicos, a fin de entender cabalmente las cuestiones técnicas y no desnaturalizar la propuesta medieval. Los primeros tres capítulos se abocan a cuestiones introductorias, históricas y a la genealogía de los tópicos más importantes. El cuarto capítulo está dedicado a la presentación sintáctica del lenguaje de la lógica medieval. El quinto y el sexto a la metateoría de esta lógica. El séptimo explora y presenta la semántica. Los dos últimos nos brindan una reconstrucción racional, en términos del lenguaje simbólico contemporáneo, de la lógica de finales del siglo XIV. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. Aristotle’s Politicsis not only famous for its theory of constitutions, but for its statements about human nature. According to the central claim of Aristotle’s political anthropology, man is by nature a political animal (phusei politikon zôon). This famous statement is presented as the conclusion of the first set of arguments that Aristotle develops in the second chapter of book I of the Politics(Pol.,I, 2, 1252a24–1253a3). Aristotle’s statement is inextricably linked with the claim that the polisexists by nature (phusei), which he (...) mentions in the same phrase, as part of his conclusion: “From these considerations it is evident that the polisis one of the things that exist by nature, and that man is by nature a political animal”(Pol.,I, 2, 1253a1–3). Evidently, the claims that the polisexists by nature and that man is by nature a political animal are complementary. This article presents an interpretation of the two complementary claims or theses arguing that in Pol.,I, 2 Aristotle conceives exclusively of human beings as political animals because the whole chapter focuses on theanalysisof the polis,a community peculiar to humans. Italso examines Aristotle’sclaim that the polis“is by nature prior (proteron) to the household and to the individual”(Pol.,I, 2, 1253a18–19). The paperdisagrees withscholars whounderstand this claim as an independent third thesis and theoremand argues that Aristotle’s claim functions as a strong argument for the thesis that man is by nature a political animal. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. Castañeda, Perry and Lewis argued in the 1960’s and 1970’s that thoughts about oneself “as oneself” – de se thoughts – require special treatment, and advanced different accounts. In this paper I discuss Ernest Sosa’s approach to these matters. I first present his approach to singular or de re thought in general in the first section. In the second, I introduce the data that need to be explained, Perry’s and Lewis’s proposals, and Sosa’s own account, in relation to Perry’s, Lewis’s, (...) and his own views on de re thought. In the third section I present the account I prefer – a “token-reflexive” version of Perry’s original account that Perry himself came to adopt in reaction to Stalnaker’s criticisms. In the final section I take up Recanati’s recent arguments, from a viewpoint on de se thought very similar to Sosa’s, to the effect that such an account is in a good position to explain the phenomenon of immunity to error through misidentification. I argue there that that is not the case, and I conclude by suggesting that the token-reflexive account fits better both with the data and with Sosa’s Fregean take on de re thought in general. In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Este artigo contribui para o debate sobre a relação da filosofia prática e teórica de Aristóteles. Ele argumenta que sua filosofia prática depende em grande parte de sua concepção teleológica da natureza. Esta tese é dirigida principalmente contra os estudiosos que sustentam que Aristóteles não deriva de relações políticas e humanas de condições naturais ou cósmicas. O artigo defende a interpretação antropocêntrica de David Sedley da teleologia natural de Aristóteles e mostra como Aristóteles aplica explicações teleológicas às relações de poder (...) entre os seres humanos - entre homens e mulheres e entre homens livres e escravos naturais - e seus propósitos e objetivos. O artigo enfoca o argumento da “função” (ergonomia) humana de Aristóteles, que é um argumento teleológico no centro de sua filosofia prática. Argumenta que este argumento, que Aristóteles apresenta para definir ‘florescimento humano’ ou ‘felicidade’ (eudaimonia), depende de sua definição de homem como o único ‘ser vivo que tem linguagem e razão’ (zôon logon echon). Alega ainda que a disputa sobre se Aristóteles identifica eudaimonia apenas com uma vida de contemplação ou se eudaimonia inclui uma vida política pode ser esclarecida referindo-se ao propósito natural dos logotipos. Resumen: Frente a la situación de ateísmo teórico y práctico que prevalece en este contexto, el presente trabajo es una síntesis de los fundamentos filosóficos sobre Dios que constituye el tema más importante de la Filosofía. Se trata de un esfuerzo por presentar de manera sintética y clara lo que se refiere al Ser, la Existencia, la Esencia y las Perfecciones divinas, y sobre el hecho de que todo ser, toda permanencia en el ser y todo acrecentamiento de las creaturas (...) se funda y es causado por Dios que es el Ser en sí y por sí, Causa primera y Causa final de todo lo existente. Es un intento por mostrar el brillo de la doctrina presentada por Santo Tomás de Aquino y por hacer ver que, a pesar de lo que haya podido decirse, la síntesis del Aquinate, acabada en sus principios y abierta en sus conclusiones, contiene un valor perenne que hasta el momento ha sido insuperable. Abstract: Faced with the situation of theoretical and practical atheism prevalent in this context, this paper is a synthesis of the philosophical foundations of God, which is the most important issue of philosophy. It is an effort to present synthetically and clearly everything related to the Being, the Existence, the Essence and the Divine perfections, and the fact that any being, any remaining in being and any growth of creatures is founded and is caused by God who is the Being in and of Himself, the first cause and the final cause of all that exists. It is an attempt to show the brilliance of the doctrine presented by St. Thomas Aquinas and to show that the synthesis of Aquinas, finished in its principles and open in its conclusions, contains a perennial value that, despite what has been said, has not yet been surpassed. Abstract The present work is a metaphysical analysis of the relation between the intellect and the will, starting from the solution offered by Saint Thomas Aquinas to the intellectualist and voluntarist proposals of his time. Through the application of the doctrine of the act and power discovered by Aristotle, and with the important elements that Christianity had contributed by the thirteenth century, St. Thomas solves the problem of the production of universal concepts in an environment of concrete material realities. The (...) contribution of St. Thomas consists in having achieved a moderate intellectualism, granting each faculty the value and preeminence that corresponds to it, avoiding relativistic voluntarism and reaching a depth that is unique in metaphysical realism in the history of thought. En el pensamiento de Santo Tomás de Aquino, la Filosofía Moral y la Teología Moral tienen al bien como concepto central, es decir, el ser en cuanto apetecible y en cuanto fin de la tendencia o apetito. Lo anterior es debido a que lo bueno expresa el en cuanto se relaciona con el apetito y de este modo señala la capacidad del ser para mover la voluntad o una tendencia cualquiera hacia su fin. Es por esto que Santo Tomás sostiene (...) con Aristóteles que el bien coincide con la noción de fin. Y es por la importancia de estos principios y por la repercusión en la moral y sobretodo en la explicación de la libertad moral, que este breve trabajo consiste en una profundización en las relaciones entre el bien, el fin y la naturaleza y algunas de sus aplicaciones a lo que se conoce como tendencia natural o apetito natural y la tendencia libre que se refiere a la voluntad sobre todo a la voluntad de la persona humana. No se trata de un intento por presentar todas las conclusiones que de estos principios se siguen, lo cual correspondería a la Filosofía o a la Teología Moral, sino más bien de una profundización en los principios metafísicos, para asentar los cimientos del orden moral. -/- In the thought of St. Thomas Aquinas, both ethics and moral theology have as their central concept of the good, that is, of being insofar as it is desirable and insofar as it is the end of appetitive tendencies. This is due to the fact that the good expresses being insofar as it relates to the appetite, and thus it expresses the capacity of being to move the will, or to any tendency towards its end. For this reason St. Thomas holds with Aristotle that the good is convertible with the notion of end. And it is due tuo the importance of these principles and their consequences for morality and moral freedom that in this brief work I attempt to delve into the relationship between the good, the end, and nature, and some of its applications to what is known as natural tendency or natural appetite as well as to the free tendency which is called "the will", especially the will of the huma person. It is not an attempt to present all the conclusions that follow form these principles -a task that would correspond to ethics or to moral theology- but attempt to delve into the metaphysical principles that ground the moral order. Resumen: Es un hecho que Dios ha impreso de un modo necesario e indefectible la dirección hacia su fin a las creaturas materiales y a las creaturas espirituales incluido el caso concreto del hombre. Pero también es un hecho que en el mundo corpóreo, la persona humana cuenta con la libertad de los medios para alcanzar dicho fin. En esto se distingue el hombre de los animales irracionales, en que la naturaleza espiritual y libre ha de ser encauzada en su (...) actividad por una ley específicamente distinta a la del mundo irracional, que a la vez de conducirla eficazmente hacia su fin, sea compatible con la libertad. Dada la relevancia de este tema para la comprensión del problema moral del hombre, el objeto de este trabajo es profundizar en la naturaleza del acto libre y por ende en los principios que fundamentan la libertad en el pensamiento de Santo Tomás de Aquino quien sin lugar a duda ha logrado una gran profundidad en el análisis del acto humano. Palabras clave: acto - bien - felicidad - fin - libertad -/- Abstract: God has impressed upon both material and spiritual creatures, including the concrete case of man, a necessary and indefectible direction towards their end. But at the same time, in the corporeal world, the human person possesses a special freedom with regard to the means whereby to reach that end. This is precisely what distinguishes man from irrational animals: that our free and spiritual nature must be directed in its activity by a law specifically distinct from that of the irrational world, such that, while it drives us towards our end, it remains compatible with free will. Given the relevance of this theme for the understanding of the moral problem of the human person, the goal of this work is to delve more deeply into the nature of free human acts and therefore into the foundational principles of free will in the thought of St. Thomas Aquinas, who undoubtedly has offered a profound analysis of human acts. Discuto en este trabajo el adecuado tratamiento de un interesante problema semántico, largamente tratado por David Kaplan (1973). El problema fue propuesto originalmente por Richard Cartwright. Después de exponerlo, presento y comento cuatro soluciones. Las soluciones proceden del trabajo de Kaplan; me he tomado no obstante algunas licencias en su presentación. Paso después a proponer una nueva solución al problema de Cartwright, en consonancia con puntos de vista, hasta cierto punto contradictorios con los de Kaplan, que he venido defendiendo en (...) trabajos previos sobre la semántica de indéxicos y nombres propios. El objetivo principal que el trabajo persigue es ofrecer una confirmación indirecta para tales puntos de vista, en tanto que sobre la base teórica que nos proporcionan podemos ofrecer una solución a la paradoja de Cartwright más satisfactoria que las otras hasta ahora propuestas. Um der Komplexität und den Interdependenzen dieser Systeme gerecht zu werden, ist auf verschiedenste Fachbereiche und deren Zugänge zurückzugreifen. Diese bilden die Grundlage, um Lernende zu befähigen, sich selbstbestimmt und emanzipiert mit den gesellschaftspolitischen Fragen des 21. Jahrhunderts auseinanderzusetzen. Las artes escénicas y su financiación han tenido un rol preponderante en los estudios económicos de la cultura. Múltiples publicaciones se han centrado en la pertinencia de la intervención estatal tanto como agente que realiza el financiamiento, como proveedor y productor de servicios culturales, así como a que fallos de mercado debe dar respuesta el estado. Asimismo - aunque no con la asiduidad y la profundidad deseada-, han surgido diversos artículos sobre la gestión de las artes escénicas en el marco (...) de las nuevas tendencias de la Contabilidad de Gestión. El presente trabajo defiende la relevancia que tienen los indicadores de gestión como herramientas apropiadas para evaluar el desempeño de las políticas culturales, y trata el caso específico de las orquestas sinfónicas financiadas con fondos públicos. El objetivo último es monitorear el cumplimiento de la estrategia y medir el empleo eficiente y eficaz del uso de los recursos utilizados, así como evaluar la rentabilidad social y cultural alcanzada. Asimismo, se plantea en este trabajo un cambio en la estrategia actual de los organismos sinfónicos de Montevideo con el objetivo de incrementar la rentabilidad social y cultural. -/- . (shrink)

In this paper I will examine the relationship between constitutionalism and democracy as the alleged tensions between them appear in diagnoses about the crisis of liberal democracy. The issue is approached through the arguments of the German jurist Martin Kriele, who holds the thesis that there can be no sovereign in the constitutional State. I will begin by explaining this thesis as well as the justification offered by Kriele. According to him, the guarantee of rights and freedoms is only possible (...) within the framework of the constitutional State. Hence, he advances a second related thesis, that democracy can only be developed in the constitutional State, that is, as constitutional democracy. However, this second thesis seems in contradiction with the first if the democratic principle implies popular sovereignty. To resolve this apparent antinomy, I will distinguish with Kriele two rival conceptions of democracy in order to point out the danger of misinterpreting the meaning of constitutional democracy. -/- En este trabajo examino la relación entre constitucionalismo y democracia, puesto que las supuestas tensiones entre ambos aparecen en los diagnósticos sobre la crisis de la democracia liberal. La cuestión se aborda a través de los argumentos del jurista alemán Martin Kriele, quien defiende la tesis de que no puede haber soberano en el Estado constitucional. Empezaré por explicar dicha tesis así como la justificación de ella que ofrece Kriele, para quien la garantía de los derechos y libertades sólo es posible en el marco del Estado constitucional. De ahí que avance una segunda tesis relacionada, cuando sostiene que la democracia sólo puede desarrollarse en dicho Estado constitucional, esto es, como democracia constitucional. Sin embargo, esta segunda tesis parece contradictoria con la primera si identificamos el principio democrático con la soberanía popular. Para resolver esa aparente antinomia, se distinguiré con Kriele dos concepciones rivales de la democracia, a fin de señalar el peligro de malinterpretar el sentido de la democracia constitucional.
